TERMS AND CONDITIONS
We will not sell, rent, loan, trade, or lease any personal information collected by us for commercial purposes, including application forms, download requests or email lists.
In these terms and conditions:
Charity means Child Cancer Foundation
Claim means a claim to IRD for a donation tax credit for a donation of $5 or more made using an IR526 form.
IRD means the Commissioner of Inland Revenue.
We, us or, our mean Charity Booster Limited.
Scope of Services
When you make a donation to Charity, you have the option to provide your IRD number to us to allow us to make a Claim on your behalf and pay the tax refund to Charity.
If you need to file an IR3 tax return to IRD, we can only submit the Claim after you have filed your IR3 tax return.
We will use your name, contact details and IRD number to submit the Claim to IRD.
We will collect your tax refund and pay it to Charity.
We will only make a Claim for you with your prior consent.
You may withdraw your consent at any time before we submit your Claim to IRD. Any Claim that we have sent to IRD will not be interrupted.
We will not use your name or contact information for any purpose except to make a Claim.
We will securely store and protect any personal information and data we receive from you.
If you are required to file an IR3 tax return we will submit your Claim in the next financial year.
We do not limit or exclude our liability or obligations under the Consumer Guarantees Act or the Fair Trading Act.
You authorize us to sign your IR526 form and to communicate with IRD to lodge and process your Claim as your duly authorized agent.
You warrant that all information you provide to us is true and correct.
We have no liability to you, and you indemnify us, if the information provided by you is incorrect, incomplete or misleading.
Fees & Charges
We will charge Charity a fee of 10% of the refunds we receive from IRD. We will also donate 10% of our net profits to Charity.
Privacy of your data
We will ensure that all personal information collected by us is held securely, is kept confidential and is not used for any purpose other than processing Claims, and auditing compliance with our and Charity’s legal obligations.
Update and Changes
We may change our terms and conditions (including our fees) from time to time on 21 days' notice.
If we make a change to these terms and conditions, you will be asked to agree to our current set of terms, conditions and fees.
Resale or Disclosure of Information to Third Parties
We will not sell, rent, loan, trade, or lease any personal information collected by us for commercial purposes, including application forms, download requests or email lists. However to be able to provide the services we do we need to share your data with IRD and Charity, and we may also be required or permitted by law to disclose certain information to government agencies.
Security of Your Data
We will securely store and protect any private data we have in regards to the preparation of Claims by securing storing and protecting your data using industry best practise solutions. These include storing your data in a 24/7 secure data centre in New Zealand and training all of our staff in the importance of maintaining confidentiality of client information.
Retention of Your Data
NZ law states that we must retain copies of your personal data for up to 7 years. Information no longer required is disposed of by secure destruction.
Privacy of Your Data
We will ensure that all client information is held as private and confidential. Information collected in writing and/or verbally for preparing Claims can and may be used for internal auditing purposes by us, provided to IRD for external auditing purposes, and used for any other purpose authorised by you.
All communication between us and you is logged for security purposes. Telephone conversations between you and us may be recorded. This information is never given, sold, leased or otherwise disclosed to any third party, unless expressly required or permitted by law.
